TERMS AND CONDITIONS
TRIMHOMBRE LLC (later on as TRIPHOMBRE) is an American Travel Agency based in New York City, NY USA.
RESERVATIONS
The quickest way to reserve is to book online on our website picking up tour and making full payment. Or you can call to 1-347-730-6660, if you’ll have difficulty in booking online or have any questions/ clarifications before booking/purchasing the tour. Or you can send us enquiry, if you’re looking for some other programs. Early enrollment is always encouraged as group size is limited and some trips require greater preparation time (it is related to scheduled group tours).
Once we receive tour purchase order with payment from you side, we’ll start booking services as per the itinerary. To finalize your booking, we’ll send you by email “Reservation Form” and “Release of Liability and Assumption of Risk Agreement” to complete and sign them. You need to send photocopy of them along with a color copy of your passport by email or print our all the forms, including a color hardcopy of your passport, and mail to TRIPHOMBRE.
Once we receive these documents, we will send you a comprehensive confirmation packet which includes a Descriptive Daily Itinerary and travel tips for the countries you’ll visit, and payment receipt with invoice. You are advised not to book air arrangements until the tour has been confirmed with the exact dates. Visa kits for applicable trips are generally sent out about 3-4 months prior to departure. A final packet with an updated itinerary and contact information is generally sent 2-3 weeks prior to departure. (Note that international shipping charges will apply for non-U.S. addresses.)
TRAVELERS’ RESPONSIBILITIES & ELIGIBILITY
In booking with TRIPHOMBRE, you understand and agree that TRIPHOMBRE purchases or reserves travel-related services on your behalf from independent service providers that will provide components of the tour, including but not limited to transportation, lodging, restaurants, and other services. Because TRIPHOMBRE does not own or control any of these independent service providers and suppliers, it is not responsible for any delay, inconvenience, accident, expense, injury, loss, death or damage caused by any negligent or willful act or failure to act or default of any such service provider or supplier.
Travelers are responsible for selecting an appropriate tour that matches their interests and physical abilities, for preparing for the tour by studying the Descriptive Daily Itinerary and additional trip information sent by TRIPHOMBRE, for bringing all necessary equipment and clothing, and must abide by the authority of our Tour Leaders and/or local agents and guides. By booking and participating in a tour, you represent that you do not have any physical or other conditions that would create a hazard for you or other participants or affect other people’s enjoyment of the tour.
You will be responsible to provide correct information regarding personal details (passport name, address, contact information) and flight information (if applicable). We will not be responsible for costs incurred due to incorrect, incomplete or inaccurate information. You must have a valid passport for international travel. Your passport should be valid for at least six months beyond the date you expect to return home. You are responsible for arranging visas or travel permits, if applicable. Medical vaccination certificates may be required for entry in some countries. Under normal circumstances you will receive your final tour documents two weeks prior to departure unless delayed by a supplier providing information or documentation.
Trip members grant TRIPHOMBRE permission to take a photographic record of its trips for promotional and commercial use.
Travelers must be 18 years of age or older (or traveling with a legal guardian) and physically and mentally capable of participating in the tour. Reservations are subject to our review and acceptance of your completed Reservation Form and signed Release of Liability and Assumption of Risk Agreement. We reserve the right at our sole discretion to request additional information or medical clearance at any time from a traveler. We also reserve the right at our sole discretion to accept, decline, or remove anyone from a tour (at or prior to departure or during the tour) for any reason, including but not limited to if we believe a person is incapable of meeting the tour’s physical or mental demands.
OUR RESPONSIBILITY
We act as an agent for the owners and/or contractors providing the services and means of transportation specified. All tickets and vouchers are issued subject to terms and conditions. We assume no responsibility in connection with any injury, death, loss, accident or delay which may be occasioned either by reason of defect or through the acts of default of any company or person engaged in carrying out arrangements of the tour or flights. No responsibility is accepted for any changes in schedule or other events resulting from improper health certificates or travel documents or as any act of any seasonal variation, labor strike, civil disturbance, political unrest and natural acts. We cannot guarantee that accommodations, ground transportation, airline, ferry, rail, cruise ship or similar service will be exactly as outlined in the general catalogs, website day-by-day itineraries or other promotional literature. Extreme care is taken in the contracting of all services, however we cannot be responsible for the errors or omissions of the suppliers or services. In the unlikely event that a supplier fails to honor their contract with us, we reserve the right to alter, change or cancel such services outlined in our literature. When such a change occurs, we will endeavor to substitute comparable services, although we will not be liable for any difference in the quality or enjoyment. Tourism is still developing in many destinations, and thus facilities and services may be under construction and repair. We will endeavor to alter trip arrangements should we be forewarned of such occurrences.
CUSTOMER SERVICE & CLIENT FEEDBACK
We will provide you with a Tour Questionnaire in your final documents package. We encourage completion of this questionnaire in order to ascertain deficiencies, inaccuracies and positive feedback regarding our service, the tour, and Tour Leader. Any complaint you have while on tour must be brought to the Tour Leader’s attention immediately. If the matter cannot be rectified during your trip, please forward your complaint in writing to our office within 30 days of your return. (We will not be responsible for unsettled complaints not received within 30 days of your return.) We may require 60 days from receipt to respond. In the event a mutual agreement cannot be reached, this contract may be interpreted in the court system in accordance with the law. In the event of a legal dispute the prevailing party will be entitled to reimbursement of legal fees.
PAYMENT
For reservations made directly with TRIPHOMBRE on the website online, land tour payments are accepted by credit cards (Visa, MasterCard, Discover or Amex) and PayPal. Full payment for land tours is due at the time of booking for reservations online, as TRIPHOMBRE may be required to pay for services and accommodations immediately, and in full at time of reservation, on your behalf. Bookings from outside of North America will be charged in US Dollars. Your verbal/online authorization to take payment confirms your acceptance of these Terms & Conditions and your reservation whether or not you have signed the appropriate credit/charge card draught. We require a signature on file for final payment by credit card, even if payment has already been made.
CANCELLATIONS & REFUND POLICY
Should you need to cancel your travel plans, please notify us immediately by email, letter or by fax.
At the time we receive written notification of cancellation, the following charges will apply:
If received up to 61 days or more prior to departure – non-refundable deposit of $500
31-60 days prior to departure – 50% of the land tour cost
30 days prior to departure or after trip departure – no refund
Deposits are nonrefundable, though if you cancel more than 60 days prior to tour departure date, the deposit is transferable to any other tour taken within 12 months of the original tour start date, minus a per person transfer fee (some tours have a 100% nonrefundable/nontransferable deposit; you will be informed of this at the time of booking). Name changes are not permitted.
PLEASE NOTE:
We will not be responsible for costs associated with re-issuance or extension of visas, airline change fees, or for any compensation.
We will not be responsible for any expenses incurred, such as visas, vaccinations, independently purchase airfare, or any compensation. Notice of cancellation due to insufficient enrolment in any program will be given approximately 60 days prior to departure.
No partial refunds are available for any missed days of a tour or any whole or part of a tour, accommodation, meal or any other service not used by the participant during the tour.
TRIPHOMBRE LLC reserves the right to cancel any tour prior to departure for any reason whatsoever, including but not limited to too few participants or circumstances outside our control such as geopolitical turmoil, wars, natural disasters, or supplier issues, in which case a refund of the land tour payment will constitute full settlement. If we cancel your tour due to insufficient enrolment, we will endeavor to find an alternative tour for you. If this is not acceptable, all monies paid will be refunded in full and will constitute full settlement. In the event of cancellation, TRIPHOMBRE is not responsible for any expenses incurred by travelers in preparation for the trip (e.g. non-refundable airline tickets, visa fees, etc.).
VISAS, PASSPORTS & TRAVEL ADVISORIES
A valid passport with six months validity from the end of the tour is required for participation. Travelers are responsible for obtaining all necessary visas prior to departure. TRIPHOMBRE cannot guarantee visa or permit approval by foreign governments, and cannot assume responsibility for incorrect or improperly issued visa, permit or passport documentation, nor for any costs associated with a traveler’s refused visa or permit issuance or refused entry into a country due to incorrect or incomplete documentation.
Travelers are responsible for their own welfare while traveling and for educating themselves on the conditions in the countries they will be visiting during the tour. For information concerning possible dangers at an international destination, contact the government office in your country that is responsible for issuing travel advisories. In the U.S., contact the Travel Advisory Section of the U.S. State Department, 1-888-407-4747, http://www.travel.state.gov/. For medical information, contact the U.S. Centers for Disease Control (CDC), 800-232-4636, http://wwwnc.cdc.gov/travel/, or the responsible government agency in your country.
ITINERARY & PRICE CHANGES
Published itineraries are subject to change without notice due to changing conditions in the field. As trips are priced more than a year in advance, we reserve the right to change the land cost in the event of significant increased costs over which we have no control, including but not limited to changes in internal airfares, fuel surcharges and currency fluctuations.
We take great care to ensure the accuracy of our itineraries and promotional literature; however, circumstances beyond our control may necessitate changes to tour content and changes in tour dates. In the case of content change, you must refer to the tour itinerary included with your final documents package as it may have been updated since you booked your trip. In the case of a shift in dates, we will notify you as early as possible of such changes so that necessary adjustments can be made. Changing conditions in the field may also necessitate itinerary modifications after the trip has departed. Tour members are responsible for all increased costs associated with en route itinerary changes or changes in means of conveyance, hotels, Tour Leaders, etc.
ADDITIONAL FEES & CHARGES
Additional charges for single supplement, extra accommodation, visa/permit fees, international air taxes / fuel surcharges, domestic air taxes, arrival / departure transfers (for Land Only customers), will be added to your invoice, if applicable.
SPECIAL REQUESTS
Hotel check-in on the first day of the tour will be in accordance with the hotel’s usual check-in times (except tours which include early check-in within tour cost). Though we will request early check-in for early arrivals, we regret that this cannot be guaranteed. We will attempt to accommodate special requests by notifying the suppliers in writing. Though unlikely, we cannot guarantee that special requests – room locations, adjoining rooms, meal requirements for flights or hotels, seating requirements for flights, etc – will be adhered to by our suppliers.
SINGLE TRAVELERS
If you prefer single accommodations, the single supplement fee/single occupancy rate is payable (will be billed separately, as our all tours are based on minimum 2 person travelling). Single accommodations are not always available, as some nights may be spent in yurts/gers, tents, lodges, guesthouses, aboard regularly scheduled rail service or in private homes and are subject to the availability of rooms and/or camping space. A partial single supplement is available on tours that employ non-hotel accommodation for some nights.
We are happy to attempt a same-gender roommate match for solo travelers who request it on small group tours. Should no one be available with whom you can share, you will be assessed the single supplement fee/single occupancy rate at the time of invoicing. In the event of a last-minute cancellation or roommate incompatibility resulting in assignment of a single room, the single supplement fee/single occupancy rate will be assessed.
Upgrading to single room once the tour has begun is subject to availability in each overnight point, and payment must be made immediately to our office or locally to the Tour Leader. If you want to guarantee your own room, a single supplement applies. Payment of single supplement does not, however, guarantee that you will receive a twin size, twin-bedded room.
LAND TOUR COST
Prices listed in this website are per person in U.S. dollars, based on double occupancy and minimum 2 person travelling. Land Tour inclusions for each tour are outlined in the Descriptive Daily Itinerary. In all cases, the quoted price represents a package price for the services offered and an itemization of individual component costs will not be provided.
Prices do not include international airfare and related taxes and fuel surcharges, airport departure or other fees, visa fees, passport expenses, cost increases of internal airfares, customary end-of-group-tour gratuities to tour managers, some meals on some trips, alcoholic beverages, insurance, single supplement (by choice or circumstance), baggage fees not included in the fare, items of a personal nature such as laundry, phone calls/email; or expenses arising from the delay, extension or modification of a tour due to bad weather, flight delays, sickness or medical emergency, government action, or any other cause beyond our control.
TRIPHOMBRE reserves the right to add staff or invited guests to any of our group departures, even if such addition exceeds the advertised group maximum size.
LIMITATION OF REMEDIES
You agree that the sole remedy for any default by TRIPHOMBRE arising under this agreement shall be the return of the paid Land Tour cost, to the extent consistent with applicable law. To the maximum extent permitted under applicable law, TRIPHOMBRE shall not be liable for any special, consequential, indirect, punitive, incidental or other damages arising out of or in any way connected to this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if TRIPHOMBRE has been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages.
FITNESS & MEDICAL INSURANCE
If you will be 70 or older at the time of travel you will be required to complete and sign a questionnaire that affirms your suitability for your chosen tour. Certain tours, including those involving high altitude and/or walking/trekking, require a medical questionnaire to be completed and signed regardless of age. We require that all passengers be medically insured. Once you have been confirmed on a trip that requires a medical certificate, you will be required to submit it no later than 90 days prior to departure.
FORCE MAJEURE
TRIPHOMBRE will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure.
“Force Majeure” means any circumstances beyond TRIPHOMBRE’s reasonable control, including without limitation forces of nature, terrorist activities, geopolitical disturbances, explosions, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, quarantine, government intervention, weather conditions, and unforeseen circumstances. If TRIPHOMBRE and any of our suppliers are affected by Force Majeure, we and our suppliers shall be entitled to, and may in our sole discretion, vary or cancel any itinerary or arrangement in relation to the tour.
